These Terms govern your use of Pacer: the website at pacermusic.co, the application behind it, and everything we provide through them. By creating an account or using Pacer, you agree to them. If you do not, do not use the service.
Our Privacy Policy explains how we handle personal data and forms part of this agreement.
You must be at least 16 years old. If you are using Pacer for a label, management company or any other organisation, you confirm you are authorised to accept these Terms on its behalf, and "you" means that organisation.
You may not use Pacer if we have previously terminated your account, or if the law where you live prohibits it.
You are responsible for your account, for keeping your sign-in method secure, and for everything done through it. Tell us promptly at hello@pacermusic.co if you believe it has been compromised.
Give us accurate information and keep it current. You may invite other people into a workspace; when you do, you are responsible for what they do with the access you grant, and for making sure they are entitled to see the data in it.
Pacer includes a 14-day trial. After it ends, continued access to paid features requires an active subscription at the price shown at checkout.
Payments are handled by Stripe. Subscriptions renew automatically for the same period until you cancel, and cancelling takes effect at the end of the period you have already paid for; you keep access until then. We do not give partial refunds for unused time unless the law where you live requires it.
If a payment fails, we may suspend paid features until it succeeds. We can change prices, but not mid-period: a change applies from your next renewal and we will give you notice before it does.
The free release audit stays free and does not require a card.
You agree not to:
- Connect an account you are not entitled to control, or use Pacer to access someone else's data without their permission.
- Send unsolicited bulk email, spam, or any outreach that breaks the anti-spam and data protection law that applies to you or your recipients.
- Use Pacer to harass, impersonate, defame, or infringe anyone's rights.
- Upload or generate material you do not have the rights to, or that is unlawful.
- Attempt to break, probe or overload the service, evade rate limits, or reverse-engineer it beyond what the law permits.
- Resell or white-label Pacer, or use it to build a competing product.
- Use automated means to extract data from Pacer beyond the features we provide.
Outreach in particular. When Pacer sends an email on your behalf, you are the sender. You need a lawful basis to contact each recipient, you must honour unsubscribe requests, and you must not disguise who the message is from. We may suspend outreach on an account that generates spam complaints.
Connecting Spotify, TikTok, Instagram or any other service is optional and is between you and that platform. Their terms continue to apply, and you must not use Pacer in a way that breaks them.
These platforms change their APIs, pricing and access rules without consulting us. If one restricts or withdraws access, the Pacer features that depend on it may degrade or stop working. We will do what we reasonably can, but we cannot promise a third-party integration will keep working, and a change of that kind is not a breach of these Terms.
Your music, artwork, copy, context files, contacts and everything else you put into Pacer remain yours. We claim no ownership of them.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit and process that content (including sending relevant parts to the model providers described in the Privacy Policy) strictly to operate and improve the service for you. That licence ends when you delete the content or your account, except for backup copies that age out on their normal cycle.
You confirm you have the rights to everything you upload, and that our processing it as described will not infringe anyone else's rights.
Pacer generates plans, drafts, images and recommendations using language and image models. As between you and us, you own the output generated for you and may use it commercially, subject to these Terms.
Understand what that output is. It is a prediction, not a fact. It can be inaccurate, out of date, or plainly wrong. Because these models are shared, output generated for another user may be similar or identical to yours, and we cannot promise it is unique or that it is free of third-party rights.
Nothing Pacer produces is legal, financial, tax or professional advice. Review anything before you publish it, send it, or act on it. The decision, and the responsibility for it, is yours.
Streams, listeners, followers, reach, scores, valuations and rankings shown in Pacer come from third-party data providers and from the platforms themselves. They are estimates. They lag, they get restated, and different sources disagree. Use them to steer, not as an audited record, and never as the sole basis for a financial or contractual decision.
We aim to keep Pacer available but do not guarantee uninterrupted service. We may add, change or remove features, and take the service down for maintenance. Where a change materially reduces what you get on a paid plan, we will give you reasonable notice.
You may stop using Pacer at any time, and can ask us to delete your account by emailing hello@pacermusic.co.
We may suspend or terminate an account that breaches these Terms, creates a legal or security risk, or is used to abuse other people. We will give notice and a chance to fix things where it is reasonable to do so; where the harm is serious or ongoing, we may act first.
On termination your right to use the service ends. The sections on your content, disclaimers, liability, indemnity and governing law survive.
Pacer is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that its output will be accurate, or that using it will grow your audience, revenue or career. Nothing in these Terms excludes liability that cannot lawfully be excluded, and if you are a consumer you keep your statutory rights.
To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost data or lost opportunity, arising out of your use of Pacer. Our total aggregate liability arising out of or relating to these Terms is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
You agree to indemnify and hold Pacer harmless against claims, damages and reasonable costs arising from your content, your use of Pacer, the outreach you send through it, your handling of other people's personal data, or your breach of these Terms.
We may update these Terms. The "last updated" date at the top always reflects the current version. If a change is material we will notify you in the app or by email before it takes effect. Continuing to use Pacer after that means you accept the new version.
These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them, except that if you are a consumer, you keep any right you have to bring proceedings in your own country of residence.
